Important: Veloqua provides homeowner insurance cost analysis for informational and educational purposes only. Nothing on this Site constitutes insurance advice, insurance brokerage, or a recommendation to purchase, modify, or cancel any insurance policy. Always consult a licensed insurance agent before making coverage decisions.
These Terms of Service ("Terms") govern your access to and use of Veloqua (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using Veloqua, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Veloqua uses publicly available NAIC rate filing data, FEMA risk assessments, IBHS mitigation discount schedules, First Street climate risk scores, and actuarial modeling to help homeowners understand their insurance costs. The Service provides multi-peril premium decomposition, deductible optimization via Monte Carlo simulation, mitigation ROI analysis, coverage gap detection, carrier comparison scoring, and climate trend projection. The Service is informational and educational only.
3. Not Insurance Advice
Veloqua is not a licensed insurance agent, broker, or solicitor. We do not sell, solicit, or negotiate insurance policies. The premium estimates and optimization recommendations provided are based on published rate filings and statistical models. They do not constitute recommendations to purchase, modify, or cancel any insurance policy.
You should always:
- Obtain actual quotes from licensed insurance agents before making coverage decisions
- Verify all policy details directly with the insurance carrier
- Consult a licensed insurance broker for personalized advice
- Review your state's insurance regulations and consumer protection resources
4. Data Accuracy Disclaimer
Our estimates are derived from NAIC rate filings, FEMA NFHL flood zone data, IBHS discount schedules, First Street climate risk scores, and Census/BLS construction cost indices. These sources are updated on their own schedules. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party sources.
All estimates are probabilistic, not guarantees. Actual premiums may differ from our estimates based on factors including but not limited to individual underwriting decisions, claims history details, credit-based insurance scoring variations, and carrier-specific rating algorithms.
5. Permitted Use
You may use the Service for lawful personal or commercial research purposes. You agree not to:
- Reproduce, resell, or sublicense our optimization outputs without a commercial license
- Scrape or systematically extract data from the Site beyond API rate limits
- Represent our data as official government data or as insurance advice
- Use language suggesting Veloqua "recommends" or "advises" specific coverage decisions
- Attempt to reverse-engineer our optimization algorithms or scoring methodology
6. Credits and Billing
Veloqua uses a per-report credit system. Credits are purchased as one-time payments (not subscriptions) via Stripe. Single reports cost 1 credit ($12), report packs provide 5 credits ($39), and API credit packs are available for developers. All fees are in U.S. dollars and are non-refundable except as required by applicable law. We may change pricing with 30 days' notice.
7. API Access
API subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.
8. Intellectual Property
The Service, including its design, optimization methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying government datasets are in the public domain. Our original expression, analysis, and optimization methodology are proprietary.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Smart Technology Investments LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property or confidential information.
13. Changes to Terms
We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account by contacting us and ceasing use of the Service. Unused credits are non-refundable upon termination.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service and supersede all prior agreements or understandings.
